Welcome to SparkLlama Spanish, operated by SparkLlama LLC (“we”, “us”, “our”). By accessing this website, creating an account, or purchasing from us, you agree to these Terms. They apply to all digital products and services offered through this site.
1. Digital Products and Access
All items we sell are digital. They are delivered in one of two ways:
(a) Downloadable products — PDFs, MP3s, printable materials and similar files. After successful payment you receive a download link by email and on the order confirmation page.
(b) Access-based products — interactive books, audio, activities and other materials hosted on our platform and viewed in a web browser. These require an internet connection and a current version of a mainstream browser. You receive access through your account, not a downloadable file.
No physical items are shipped.
Please confirm that your device supports the file formats or browser requirements described on each product page before ordering. Where a product page states specific technical requirements, those requirements form part of the product description.
2. Accounts and Access
Some products and areas of this site require an account. When you create one:
- You must be at least 18 years old, or the age of majority in your jurisdiction.
- You must provide accurate information and keep it current.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Access is personal and non-transferable. Credentials may not be shared, sold, or used by anyone outside your household. Access granted through a purchase covers the purchasing household only, unless a separate licence states otherwise.
We may suspend or terminate access if we reasonably detect sharing beyond the licensed household, attempts to bypass access controls, or other misuse. Where suspension results from a breach of these Terms, no refund is owed.
You may request deletion of your account at any time by contacting us. Deleting your account does not affect downloads you have already completed, but it will end access to access-based products.
3. Payments
All payments are processed securely by Stripe. We do not receive or store your full card details.
Prices are shown in USD unless stated otherwise. Applicable taxes are calculated and added at checkout based on your location and local regulations.
You agree to provide current, complete and accurate payment information. If a payment fails or is reversed, we may suspend access until the balance is settled.
4. Subscriptions and Recurring Payments
Where a product is offered as a subscription:
- Renewal. Subscriptions renew automatically at the interval shown at checkout, using the payment method on file, until cancelled.
- Cancellation. You may cancel at any time from your account or by contacting us. Cancellation stops future charges. Access continues until the end of the period you have already paid for.
- Price changes. We may change subscription prices. Existing subscribers will be notified by email at least 30 days before a change takes effect, and may cancel before it applies.
- Failed payments. If a renewal payment fails, we will attempt to notify you and may retry. Access may be suspended if payment is not completed within 14 days.
5. Refund Policy
Because our products are digital and delivered immediately, all sales of downloadable products are final and non-refundable once the file has been delivered or accessed.
For access-based products and subscriptions, you may request a refund within 14 days of purchase if you have not substantially used the materials. Contact us and we will review the request in good faith.
If you experience technical problems with a file or with access, contact us. We will make reasonable efforts to resolve the issue, including re-issuing files or restoring access. A technical problem we cannot resolve is grounds for a refund of the affected product.
Consumers in the European Union and the United Kingdom: by completing a purchase of digital content, you expressly consent to immediate delivery and acknowledge that you lose your statutory right of withdrawal once delivery begins. This consent is requested at checkout. If you do not wish to waive that right, do not complete the purchase.
Nothing in this section limits rights that cannot be excluded by law in your jurisdiction.
6. Intellectual Property and Licence
All materials sold or shared through SparkLlama LLC are protected by copyright and remain our property or that of our licensors. Purchase grants a licence to use the materials; it does not transfer ownership.
Personal / household licence (default). Unless a product page states otherwise, a purchase covers one household and the children in it, with unlimited printing for use within that household. It does not permit sharing files with other families, uploading them to shared drives, or distributing them in any form.
Extended licence. Classroom, co-op, microschool, institutional and commercial use require a separate extended licence, purchased per educator or per site as stated at the time of purchase. Using a personal licence for group teaching is not permitted.
You may not copy, resell, redistribute, sublicense, modify, or create derivative works from our products, or remove copyright notices from them.
We reserve the right to revoke access and to pursue available legal remedies in cases of infringement or unauthorised distribution.
7. Acceptable Use
You agree not to:
- Attempt to access accounts, systems or content you are not authorised to access.
- Circumvent, disable or interfere with access controls, paywalls or security features.
- Use automated means to download, scrape or copy content at scale.
- Use the site or its content for any unlawful purpose.
8. Children and Purchasers
This site is directed at adults. Products are designed for children, but purchases, accounts and communications are the responsibility of a parent, guardian or educator aged 18 or over.
We do not knowingly collect personal information from children. Accounts must be created and maintained by an adult. If you believe a child has created an account, contact us and we will delete it.
9. Updates to These Terms
We may update these Terms from time to time. The version in force is the one published on this page, with the date of last revision shown above. Material changes will be announced on the site or by email to registered users before they take effect.
Continued use of the site after an update means you accept the current version. If you do not agree, you should stop using the site and may cancel any subscription before the next renewal.
10. Disclaimer and Limitation of Liability
We work to keep this website and our products available and functioning. However, we do not warrant uninterrupted or error-free operation. We are not responsible for:
- Temporary unavailability of the site, including scheduled maintenance.
- Failures of third-party services, including hosting, payment processing and email delivery.
- Problems caused by your internet connection, software, device or browser.
- Loss of access resulting from your failure to keep your credentials secure.
To the maximum extent permitted by law, SparkLlama LLC is not liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, our products or this site. Our total liability for any claim relating to a product is limited to the amount you paid for that product.
Nothing in these Terms excludes liability that cannot be excluded by law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, where SparkLlama LLC is organized, without regard to its conflict of law provisions. Any dispute will be subject to the jurisdiction of the courts of that state, except where mandatory consumer protection law in your country of residence provides otherwise.
